Aguirre: A VP Presidential Appointee has more chances to Replace Robredo than Bongbong Marcos

The President has the power to nominate a replacement for a vacant vice presidential post from among members of the Senate and House. This is subject to the approval of a majority of Congress voting separately.  Justice Secretary Vitaliano Aguirre II said that when Robredo is removed from office after impeachment in the House of Representative, Bongbong Marcos cannot immediately claim the post. A resolution of the Presidential Electoral Tribunal that favors his protest against Robredo is needed to do that.

Appointment of ex-VP Guingona

Ex-VP Teofisto Guingona Jr. was appointed vice president by former President Gloria Macapagal-Arroyo after she assumed the presidency after former president Joseph Estrada’s impeachment on plunder charges following a public outcry called the People Power 2.




Pimentel is Next in Line

Under the law, it is the third highest official that can immediately succeed the vacancy in the vice president post. Aguirre explained as he refers to Senate President Aquilino Pimentel III or Koko Pimentel. Aguirre cites the order of succession in the top posts under Article VII, Section 7 of the Constitution. It states that the Senate president is 2nd in line of succession to the vice president.

House Speaker is also in the VP Succession Line

Speaker Pantaleon Alvarez, who discloses the plan to impeach Robredo when congress resumes, is next in line to Pimentel. He is in the 3rd spot in the VP succession line followed by Chief Justice Maria Lourdes Sereno. Sereno is in the 4th spot.




CA Scrutiny on a VP Appointee

The appointee, however, must pass the senate and congress approval. If Pimentel or Alvarez is bypassed, it can mean trouble in the judiciary system. Besides, the president’s appointee cannot easily get through the Commission on Appointments or CA – just like in the case of Perfecto Yasay for DFA and Gina Lopez for DENR. So, Aguirre urges Marcos to push the electoral protest with all his might.
