Macalintal is Clearly Not Fair – No Justice can be Expected from One-Sided Counsel

While Bongbong Marcos struggles to lower the required bond, veteran election lawyer Romulo Macalintal said that the former senator should pay P185 million, not just P66 million. This is his take on the election protest against his client, Leni Robredo to proceed. He elaborates only on the total number of precincts. Macalintal failed to mention that in an automotive election, the count should be per clustered precincts. Where is justice?

[VIDEO]: Veteran election lawyer Romulo Macalintal said Monday, April 17, that former senator Ferdinand Marcos should pay P185 million, not just P66 million, in order for his election protest against Vice President Leni Robredo to proceed.

Reliability of the VCMs

Robredo’s lawyer explains that Marcos’ protest covers the entire election system. This is because he questioned the integrity and reliability of the vote-counting machines (VCMs). It includes storage devices in 92,509 clustered precincts, which consist of 369,138 established precincts.

Manifestation in Lieu of Ordered Payment?

Robredo’s camp submitted a manifestation to the Supreme Court, sitting as the Presidential Electoral Tribunal or PET.  They disregard the SC’s order of payment where Marcos and Robredo have to pay P66 million and P15 million, respectively. These are fees for the recount of the ballots being contested. Marcos complied – Robredo haggles.

PCOS Choice

Macalintal argued that their manifestation should suspend the deadline for the payment ordered by SC. They are hesitant to settle the amount because they are not certain if Marcos’ evidence that Robredo is the PCOS’ choice can put weight on the case. Should the court insists, they have no choice but to pay their dues – but Marcos said that their case should be dismissed for non-compliance.

People’s Choice

Marcos’ lawyer Vic Rodriguez said that after paying P36 M to comply with the SuprememCourt’s order, they filed a motion for reconsideration last week. They asked the court to compute for the clustered precincts being contested and not per established precincts to lower the deposit. The action really proves that Bongbong Marcos is confident as the people’s choice.
