Does Mercado Really have a Conscience Destroying Binay but Testifying only for the First Time?

Former Makati Mayor Ernesto Mercado does not have any credibility left after he allowed Senator Antonio Trillanes IV to use him by going against his ex-boss then Makati mayor Jejomar Binay. This has affected the former Vice President’s presidential bid in the 2016 elections. Despite the many accusations he made against Binay in the senate, for the first time ever, Mercado is allowed to testify in court but not against the Binay patriarch but against his wife, Dra. Elenita Binay for the case when she was Makati mayor.

Graft Charges

Prosecution presents Mercado as a witness in the Sandiganbayan trial of former Makati City mayor Elenita Binay. This is over graft charges in relation to the alleged anomalous purchase of partitions and connector brackets for the new Makati city hall. The contract is worth P72 million which is allegedly overpriced by about P21 million.

Initially Barred

Mercado was previously barred by the anti-graft court’s fifth division from giving his testimony because the prosecution then failed to establish his relevance in the case. The dispute on the Commission on Audit (COA) report that shows the irregularity in the said purchase was backed only with photocopies of the audit report.

The Original Document

Former COA Commissioner Heidi Mendoza presented the original document later claiming that Mercado personally gave it to her. This is why the Sandiganbayan permitted Mercado to testify, but only on the issue of how he got the original report. A separate permission from the court is needed for the content of the report.

Not over with Jejomar Binay

Mercado said that in 2002, Jejomar Binay gave him the COA report to negotiate with former city administrator Nicanor Santiago to prevent the build up of a case against the wife. Santiago allegedly kept the original copy until 2014 when Santiago died, Mercado said his conscience bugged him and decided to hand to Mendoza the original copy. Why now that the one-year ban for unsuccessful 2016 election candidates is nearing? Is there such thing as Binay’s return to the government that they would want to block again?
