ICC is Not a Court of First Recourse
Presidential Spokesperson Harry Roque refutes Senator Leila de Lima’s claims that the government is unable to probe alleged extrajudicial killings (EJKs). “The point is, the ICC is never a court of first recourse. People with complaints against extralegal killings must file before the Philippine courts,” Roque, who also a human rights lawyer stressed.
De Lima’s No-Brainer or No-Brain Call?
De Lima, in a strongly urges the ICC to start preliminary investigations on alleged extra killings in the country. She accuses the President of adopting a policy killing Filipinos suspected of drug use and peddling. “It’s a no-brainer. How can the ICC expect the Du30 Administration to take jurisdiction over the prosecution of EJK crimes? The President already admits that it is the very policy of his administration to kill Filipinos,” De Lima added.
Presidential Speech that Triggers De Lima
The detained senator refers to the President’s speech in Pampanga on December 7. Du30 reiterates on his drug war policy. Saying that it remains “until the dying days of his presidency or his life.” “We do not enjoy killing our own kind. It is not a good policy, but we are besieged. That is something that is very terrible,” Duterte said of his drug war. “Four million is four million addicts, 42 percent of the total barangay are contaminated with shabu,” the President lamented on its extremity.
Cannot Step in if there’s No Case in Local Court
The Philippines is a party to the Rome Statute of the ICC. Under the statute, the state is given the primary jurisdiction to try cases. The ICC only steps in when the concerned state fails to prosecute an international crime such as genocide or other crimes against humanity. Roque, however, insists that there is no unwillingness on the side of the government to probe the killings, citing cases in the Supreme Court. De Limas’s actions are allegedly part of his party’s aim to dethrone Du30 for their Liberal bet to take over before Bongbong Marcos proves that her party cheated during the 2016 elections. The recount for Marcos’ electoral protest against Robredo starts in February 2018.
Thinking Pinoy’s Joseph Nieto laid out his thoughts based on the theories he got from alleged reliable sources on the scenario that the LP tries to get rid of President Du30. January to April is crucial for the Filipino leader to stay in power or perhaps survive an assassination attempt following the Marcos’ rule book. This is to prevent the LP to rule the country again. Once Du30 gets through this stage, his appointees can dominate in the Supreme Court. Bongbong Marcos’ election protest against Leni Robredo can then progress speedily. Therefore, it is given that Ferdinand Marcos’ namesake’s VP post take over is likely to happen before the end of 2018.

Du30’s First and Second Supreme Court Appointees
Supreme Court Associate Justices Samuel Martires and Noel Tijam re the first and second appointees of President Du30 to the high court. They both came from the San Beda College of Law where the Chief Executive also graduated. This event coincides with RJ Nieto’s initial theory.
New Comelec Chair
Comelec Commissioner Sheriff Abas breaks many firsts in the poll body. He has yet to pass the Commission on Appointments to become the new Comelec chair. If so, he can be the first Comelec chair from Mindanao where the President is from. He has studied at the Ateneo de Davao University. Abas, 38, then becomes the youngest head of the poll body. Absolutely the first Comelec commissioner to become Comelec chair. By the look of it, he can be more loyal to the President than to the former President Pnoy who first appointed him as commissioner.
Abas’ Appointment Coincides with SC Changes
Abas’ nomination comes as Duterte pushes for a federal form of government. The movement requires a plebiscite run by the Comelec. Besides, the lower house is already at the back of the President with the supermajority. The remaining SC retirement replacements around the 2nd and 3rd quarter of 2018 should give the ruling party the majority votes during en banc sessions.
As a legitimate blogger, Nieto has the right to convey his analysis of the scenarios that might happen given the facts that he has access to as an avid supporter of the President. Both the administration and its detractor must play the game both in politics and through the media. It is noted that Robredo receives more favorable rulings from the Supreme Court than Bongbong Marcos nowadays. That can change drastically after the first quarter of 2018. When that happens, Nieto can be right that there is an intention for Marcos to be VP next year that can make the President safe from bad intentions.

New LP Breeds
The LP, which ruled Philippine politics during the Aquino administration. It announces the oath taking of “new members. They mostly come from the ranks of the academe, youth, professionals, and non-government organizations.” Party chairperson Vice President Leni Robredo administered the oath.
The party is now regrouping and re-branding since it fell from power after the 2016 elections. President Du30 won with a margin of more than 6 million votes against second-placer Mar Roxas, the LP’s standard-bearer. Robredo was Roxas’ running mate whose Vice Presidential victory with a slim margin is challenged by the late President Ferdinand Marcos’ namesake.
During the Aquino administration, the LP counted most lawmakers and local politicians as members and allies. Their numbers quickly dwindled after the 2016 elections. Many jump ship to the Partido Demokratiko Pilipino-Lakas ng Bayan or PDP-Laban. It is Du30’s party. PDP-Laban now leads the majority in the Senate and a “supermajority” in the House of Representatives. Many local politicians who were once members or allies of the LP have also moved to the now-ruling PDP-Laban.
Typical LP Accusations
“This so-called Dutertism is a form of leadership that does not adhere to the limits of power, does not respect institutions, does not regard or follow processes, including the rights and freedoms in the Constitution, which is disregarded under this leadership,” said lawyer Raffy Aquino, representing the new batch of LP members. From this statement alone, no one can blame the President for his criticisms of the Party. As much as he wants to get rid of Robredo as his VP, he still has to adhere to the legal electoral protest procedure filed by Bongbong Marcos as a democratic leader.
The presence of former vice president Jejomar Binay during the procession to the People Power Monument recently raises some eyebrows. This is among the Du30 and Marcos loyalists. Some are quick enough to judge. They probably don’t know the significance of it. Binay is no doubt an ally of the President because he is for the people. He is a human rights lawyer at that. The Detractors of the President and Bongbong Marcos who accuse them of human rights violations can never question Binay’s human rights role in the country. Even before the 1986 revolt. Binay’s alliance with the Du30-Marcos tandem can prove that they are not guilty of such accusations.

The President Supports Constructive Dissent
Roque stresses that President Du30 allows constructive dissent. Those who have grievances have space to protest. “The Church was very clear. It wasn’t political,” said Roque. However, this homily statement of Archbishop Socrates Villegas casts shadows over his non-political claim: “No politician lasts forever; only God does. Turn to the Lord and turn away from destructive politics. Peace to you all! We respect you. We call you Honorable. Be worthy of it,” he said.
Du30’s ICC Case
The case against Duterte before the ICC was filed amid the spate of killings linked to the government’s war on drugs.The complaint alleges that Duterte and at least 11 senior government officials are liable for murder and calls for an investigation, arrest warrants, and a trial. Roque, the only Philippine lawyer allowed to practice law at the ICC, nonetheless expressed openness to take on yet another role and assist Duterte if ever the latter would need his help.
Marcos and Martial Law
Bongbong Marcos, on the other hand, inherits the black media propaganda effects against his father. The late President Ferdinand Marcos is widely known as a dictator. He is allegedly guilty of martial law human rights violations. But he has no single case in that aspect. Most of all, the ill-gotten wealth false publicity. That ends up to be the wealth of humanity. The President already directs the Senate and Congress to look into that.
Binay’s Influence on the BiHoMaDu Alliance
The political assassination stints on the Binays still continue despite the Binay’s patriarch’s retirement from politics. He is now the Dean of the University of Makati. However, it is not a secret that his kingmaker, Pastor Boy Saycon is one of the advisers of President Du30. When some DDS supporters are not for Marcos as VP, they are supplemented by the many Binay-Honasan supporters who are solid Bongbong Marcos for VP crusaders. The BiHoMaDu alliance that stands for Binay, Honasan, Marcos, and Du30 gears Bongbong Marcos to be president someday.
Regardless of how detractors malign the nature of the relationship between the President and the Marcoses, it cannot be denied that some kind of a relationship exists. Political ideologies may be a factor but it is actually more simple. Much of President’s support comes from the political base of the Marcoses. Du30 acknowledges this by thanking Ilocos Norte Gov. Imee Marcos on many occasions during the elections and after. Bongbong Marcos ran under the ticket of the late Miriam Defensor-Santiago which is vital in the game. It helps strategically because anti-Marcos supporters of Du30 did not think twice about voting for him.

Winning Presidential Votes
President Du30 got 16.6 million votes. Assuming that all of the 5.9 million voters of his running mate, then Senator and now Foreign Secretary Alan Peter Cayetano voted for him, this would still leave 10.7 million votes which he received from those who voted for other vice-presidential candidates. Considering that there are claims that the votes of the President should have been around 21 million, that would even be the lower limit.
Bongbong Marcos’ Vital Votes
Bongbong Marcos got 14.1 million votes, at least according to the final results, something that he contests at the Presidential Electoral Tribunal. Taking this as the lower limit of his possible number of votes, and assuming that all the 1.5 million voters of Miriam Defensor-Santiago voted for him, this would mean that there are at least 12.6 million Marcos voters who voted for other presidential candidates.
Political Basis of Marcos’s Votes for Du30
It is logical to assume that a big majority of these 12.6 million voters would have voted for Du30. A lesser number of Marcos voters would have voted for former Vice President Jojo Binay and Senator Grace Poe. It is safe to assume that a Roxas-Marcos voter is a rare thing. Thus, it is hard to dismiss the contribution of the Marcos political base to the electoral success of the President.
Du30 Supporters Come to Like Marcos
It is hard to imagine that an anti-Marcos voter can accept Bongbong Marcos as Vice President simply because he is an ally of the President. Many of the President’s supporters remain anti-Marcos. However, if it is a choice between the namesake of Ferdinand Marcos or the Liberal Party’s Leni Robredo, it is a no-brainer. A number of pro-Du30 supporters now prefer Bongbong Marcos more after Robredo’s self-destructive moves. Thereby, many are hoping for the immediate resolution of his election protest against her through a recount. That would make him the legible heir to the Presidency.
