Bongbong Marcos: Martial Law Compensation is the Government’s Jurisdiction

welcome By:

Elena Grace Flores

Bongbong Marcos earlier said in an interview with CNN’s The Source, that it has been the family’s intention to settle cases regarding the wealth of his late father. However, when it comes to the alleged Martial Law Human Rights victims’ claims, it’s the government’s jurisdiction. Recently, the court denied claimants of the $2-billion (P100-billion) compensation they have been asking from the government.

Compensation Using Sequestered Wealth

The government is working on awarding compensation to claimants using the $10 billion in Marcos wealth awarded by the Swiss Federal Supreme Court in 1997. This was the account transferred to the Philippine treasury by the Swiss Federal Court in 2004. This follows after the Supreme Court here ordered to forfeit the Marcos family’s Swiss deposits in 2003.

$2 Billion Motion Lacks Merit

Thousands of human rights victims under the rule of former President Ferdinand Marcos are again denied of the $2-billion (P100-billion) compensation they have been asking from the government. The Court of Appeals in its January 3 decision junked the martial law victims’ motion for reconsideration of their claim, for lack of merit. In its July 7 decision, the Court of Appeals rules that the 1995  U.S. Hawaii District Court $2 billion award for damages to the alleged 10,000 victims of human rights abuses under the Marcos’ regime cannot be enforced in the Philippines. The Makati Regional Trial Court said the same thing in 2013.

PCGG Knows Better

The only son of the late President Marcos stresses that with regards to the overall amount of these cases, PCGG ex-chairman Andres Bautista knows better. The former Senator also said that the government can have what they can find.  He suggests asking ex-PCGG Chairman Andres Bautista to account what they have sequestered. He floats the idea that the Chair deposited some big money in small rural banks under the watch of his allies.

Cases Over 30 Years

Presidential Commission on Good Government (PCGG) Acting chairperson Reynold Munsayac reveals 282 pending cases against the Marcos family and cronies. Bongbong Marcos believes that these are dragged for over 30 years now due to political reasons. These cases must be settled with the cooperation of all parties involved. Although, he rejects the idea of immunity because he’s not the accused here. It’s also a case of double jeopardy if the heirs face a criminal trial. Double jeopardy is a defense that prevents the accused from another trial on the same charges and on the same facts after a valid acquittal or conviction. It’s the settlement in the case of the Marcoses.

Former VP Binay’s Human Rights Significance in the Du30-Bongbong Marcos Alliance

welcome By:

Elena Grace Flores

The presence of former vice president Jejomar Binay during the procession to the People Power Monument recently raises some eyebrows. This is among the Du30 and Marcos loyalists. Some are quick enough to judge. They probably don’t know the significance of it. Binay is no doubt an ally of the President because he is for the people. He is a human rights lawyer at that. The Detractors of the President and Bongbong Marcos who accuse them of human rights violations can never question Binay’s human rights role in the country. Even before the 1986 revolt. Binay’s alliance with the Du30-Marcos tandem can prove that they are not guilty of such accusations.

The President Supports Constructive Dissent

Roque stresses that President Du30 allows constructive dissent. Those who have grievances have space to protest. “The Church was very clear. It wasn’t political,” said Roque. However, this homily statement of Archbishop Socrates Villegas casts shadows over his non-political claim: “No politician lasts forever; only God does. Turn to the Lord and turn away from destructive politics. Peace to you all! We respect you. We call you Honorable. Be worthy of it,” he said.

Du30’s ICC Case

The case against Duterte before the ICC was filed amid the spate of killings linked to the government’s war on drugs. The complaint alleges that Duterte and at least 11 senior government officials are liable for murder and calls for an investigation, arrest warrants, and a trial. Roque, the only Philippine lawyer allowed to practice law at the ICC, nonetheless expressed openness to take on yet another role and assist Duterte if ever the latter would need his help.

Marcos and Martial Law

Bongbong Marcos, on the other hand, inherits the black media propaganda effects against his father. The late President Ferdinand Marcos is widely known as a dictator. He is allegedly guilty of martial law human rights violations. But he has no single case in that aspect. Most of all, the ill-gotten wealth false publicity. That ends up to be the wealth of humanity. The President already directs the Senate and Congress to look into that.

Binay’s Influence on the BiHoMaDu Alliance

The political assassination stints on the Binays still continue despite the Binay’s patriarch’s retirement from politics. He is now the Dean of the University of Makati. However, it is not a secret that his kingmaker, Pastor Boy Saycon is one of the advisers of President Du30. When some DDS supporters are not for Marcos as VP, they are supplemented by the many Binay-Honasan supporters who are solid Bongbong Marcos for VP crusaders. The BiHoMaDu alliance that stands for Binay, Honasan, Marcos, and Du30 gears Bongbong Marcos to be president someday.

Lagman Disputes the President’s “Sinless” Human Rights Remark on Imee and Bongbong Marcos

human rights

welcome By:

Elena Grace Flores

The President could not simply absolve Ilocos Norte Gov. Imee Marcos and former Senator Bongbong Marcos Jr. and describe them as “sinless” for alleged human rights abuses. They continue to benefit from the ill-gotten wealth of their father, late Ferdinand Marcos, said opposition lawmaker Albay 1st District Rep. Edcel Lagman said Saturday.

YouTube Video by;  ABS-CBN News

[VIDEO]: Albay Rep. Edcel Lagman insists the Human Rights Victims Reparation and Recognition Act of 2013 are not discriminatory.

Adult Siblings

“Although they were teenagers when martial law was declared in September 1972, they attained the age of majority shortly after the proclamation of martial law and they were already adults during the height of the martial law regime,” Lagman said. In an interview over state-run PTV 4, Du30 said that someone should not be held accountable for the sins someone else committed.

Old Enough

Lagman, a martial law victim, said that Imee and Ferdinand Jr. celebrated their 18th birthdays in 1973 and 1975, respectively. They were “old enough when the documented atrocities and plunder were committed. They were allegedly by the late Ferdinand and Imelda Marcos.”

Murder Accusation

The lawmaker recounts that Imee heads the Kabataang Barangay. It is the Marcosian counterpart of today’s Sangguniang Kabataan. That was accused of involvement in the 1977 murder of Archimedes Trajano, a Mapua Institute of Technology student. Trajano questioned her credentials. On August 31, 1977, he asked during an open forum at the Pamantasan ng Lungsod ng Maynila her capacity to lead the national youth organization. She is only the presidential daughter, he added. Trajano was found dead two days later with signs of torture.

Human Rights as an Excuse

The Hawaii District Court awarded $4.16 million to the Trajano family in 1991. It was affirmed by the US Court of Appeals, Ninth Circuit Court in 1992. Lagman said the effort of the Trajano family to enforce in the Philippines the foreign judgment was quashed by the Philippine Supreme Court. This is a mere technicality of a defective substituted service of summons to Imee. She claimed that she was then a resident of Singapore when the summons was served at the Alexandra Homes in Pasig City, her known address at that time. Perhaps Lagman forgets the rights for innocence until proven guilty.

DILG Exec: The UN Discloses that it Received Letters from the Opposition (LP) Providing Wrong Drug War Data

Drug War

welcome By: Elena Grace Flores

The Liberal Party is in a bad light now after the UN discloses that they received letters from the opposition. These contain the wrong drug war data.  A DILG executive said that it is evident that the Liberal Party is the mastermind of the misinformation campaign that aims to destabilise President Du30’s administration. DILG Assistant Secretary Epimaco Densing was told by the European Commission panel of the alleged report on massive human rights violations in the Philippines.

Youtube video from; AFP news agency
[VIDEO]: The Philippines comes under global pressure over its deadly drug war, facing calls for action following an alleged wave of extrajudicial killings.

Only One Opposition

There is only one opposition in the Philippines which is the Liberal Party. The history of liberalism dictates that it is strong in Europe,” Densing explained this to reporters. He was part of the Philippine delegation for the universal periodic review at the UN headquarters in Geneva, Switzerland last May 8.

The Liberal Party was able to strengthen their relationships and connections with their counterpart’s worldwide because of their full six-year term during the last administration. This proves that the Asian liberals and democrats are strong – as well as their ties in Europe,” Densing said. Naturally, LP party affiliations overseas would want the LP to return to power in the country, he added.

General Report

The Philippine National Police reveals that from June 1, 2016, to May 9, 2017, only around 3,000 are drug-related deaths. They are legitimate police operations. The rest are the works of vigilantes that are outlaws of society. These kinds of killings happen ever since time immemorial due to family feuds, poverty, and cultural conflicts.

Westerners particularly Europeans tend to misjudge the president because of the wrong news they receive. If the world continues to react based on what the media say, many more good leaders will be persecuted. It is just so fortunate that the people already have a voice that has no boundaries. This is through social media. When it comes to national security and issues, international bodies must verify first before reacting.

Basic Human Rights: Binay camp disagrees with using Senate hearings for demolition jobs

basic human rights

welcome By: Elena Grace Flores

The Binays particularly former Vice President Jejomar Binay are noted as human rights defenders and public service enthusiasts. This is despite their name being ruined by the Liberal Party’s demolition job. It may be successful because many still think they are corrupt. However, they do not tolerate such doings if used again. Even to their political enemies.

A Replay of the Demolition Job

Binay’s spokesperson describes the explosive testimony as “A replay of the demolition telenovela” by the Liberal Party against the former Vice President. He is pertaining to the Senate hearing of a confessed hit man on President Rodrigo Duterte’s alleged links to the Davao Death Squad (DDS).

Jejomar Binay

Liberal Party Playbook

“Thursday’s hearing (was) a page from the Liberal Party playbook.” Binay spokesperson Joey Salgado says in a statement. He also adds that the Senate investigation was conducted “in aid of demolition, not legislation. The hearings can be seen entertaining every rumor, half-truth, and hearsay. Worst, they are on live broadcast. Also published in every media. Every accusation accepted and presented as truth by senators are complemented with dramatic pauses and gestures.

The President is the Target

Said Salgado: “Once again, a political personality is declared guilty even before starting the hearings. This time the target os no less than the President himself.”

“Once again, senators are lawyering for a witness. The public is treated to a barrage of shocking but unsubstantiated statements. They are on live radio and television;” Salgado adds. Clearly a violation of basic human rights.

Confessed DDS hit-man Edgar Matobato claims during the Senate hearing of the committee on justice and human rights. That Mr. Duterte masterminds death squad killings. This allegedly happened when he was still mayor of Davao City. He says that the president ordered him and other members of the death squad to kill criminals. Opponents were slain in gangland-style assaults. That left about 1,000 people dead. The Basic human rights of the fatalities were violated as per hearings.

Televised Nationally

Salgado says that the nationally televised hearing was reminiscent of the Senate investigations of the Binay family. That highlights alleged hidden wealth as well as corruption. These were during Binay’s term as mayor of Makati City.

Binay’s Experience

The Office of the Ombudsman later files charges of graft, falsification of documents and violation of the Government Procurement Act against the former Vice President. They are in connection with the overpriced parking building constructed when he was mayor of Makati.

Younger Binay dismissed as Mayor

Ombudsman Conchita Carpio Morales also ordered the dismissal of suspended Makati Mayor Junjun Binay. This is pertaining to the controversial parking building and barred him from serving in any government position.

Ready to Defend others so as not to suffer the same Fate

“No family should go through the harrowing experience of the Binay family at the hands of Senate inquisitors. But no less than President Duterte and his family have been pilloried on live television by senators. They are showing off patented political motives. And this looks like just a warm-up,” Salgado says of the Senate hearing led by former Justice Secretary. Sen. Leila de Lima, a Liberal Party member is now a senator.

Comic interaction

Salgado reiterated Binay’s position that the Senate “does not have the competence or the authority to determine criminal liability. Only the courts can determine guilt or innocence. Not the Senate, and especially not senators with political motives.” Allowing this to go on is being negligent to basic human rights laws.

Funny Part

Binay’s spokesperson also says he was amused by the unintentionally comic interaction at the hearing between Senators Antonio Trillanes IV and Alan Peter Cayetano. They were allies during the Senate hearings on the Binays’ hidden wealth.

Cayetano’s Inconsistency

“Cayetano’s conversion into a born-again advocate of due process and the rule of law is hilarious. Considering that he lawyered for the accusers of VP Binay during the blue ribbon subcommittee hearings,” Salgado says.

Trillanes’ Consistency

He, however, gave credit to Trillanes for his consistency. “At least, Trillanes was true to form as the session hall bully. This time intimidating his erstwhile BFF. These two deserve each other,” Salgado adds.

Earlier, Senator Nancy Binay also criticises the senate hearings against Senator Leila de Lima. Her basic human rights are clearly violated. She voted to oust her as Chair of Committee on justice to stop the unfair hearings. But it continues with Senator Alan Peter Cayetano’s maneuvering.
