De Lima Influences ICC to Bring Du30 Down before Bongbong Marcos becomes VP

Bongbong Marcos said it before that the destabilizers of the Du30 administration would only stop to attack the President when he becomes Vice President. Those who are anti-Du30 just can’t stand him as his successor. This pronouncement resurfaces after Presidential spokesman Atty. Harry Roque urges the ICC to not allow it as the venue for political destabilization efforts. Jailed Senator Leila de Lima calls on it to start its preliminary investigations on EJKs.

ICC is Not a Court of First Recourse

Presidential Spokesperson Harry Roque refutes Senator Leila de Lima’s claims that the government is unable to probe alleged extrajudicial killings (EJKs).  “The point is, the ICC is never a court of first recourse. People with complaints against extralegal killings must file before the Philippine courts,” Roque, who also a human rights lawyer stressed.




De Lima’s No-Brainer or No-Brain Call?

De Lima, in a strongly urges the ICC to start preliminary investigations on alleged extra killings in the country. She accuses the President of adopting a policy killing Filipinos suspected of drug use and peddling. “It’s a no-brainer. How can the ICC expect the Du30 Administration to take jurisdiction over the prosecution of EJK crimes? The President already admits that it is the very policy of his administration to kill Filipinos,” De Lima added.







Presidential Speech that Triggers De Lima

The detained senator refers to the President’s speech in Pampanga on December 7. Du30 reiterates on his drug war policy. Saying that it remains “until the dying days of his presidency or his life.” “We do not enjoy killing our own kind. It is not a good policy, but we are besieged.  That is something that is very terrible,” Duterte said of his drug war. “Four million is four million addicts, 42 percent of the total barangay are contaminated with shabu,” the President lamented on its extremity.

Cannot Step in if there’s No Case in Local Court

The Philippines is a party to the Rome Statute of the ICC. Under the statute, the state is given the primary jurisdiction to try cases. The ICC only steps in when the concerned state fails to prosecute an international crime such as genocide or other crimes against humanity. Roque, however, insists that there is no unwillingness on the side of the government to probe the killings, citing cases in the Supreme Court. De Limas’s actions are allegedly part of his party’s aim to dethrone Du30 for their Liberal bet to take over before Bongbong Marcos proves that her party cheated during the 2016 elections. The recount for Marcos’ electoral protest against Robredo starts in February 2018.

Former VP Binay’s Human Rights Significance in the Du30-Bongbong Marcos Alliance

The presence of former vice president Jejomar Binay during the procession to the People Power Monument recently raises some eyebrows. This is among the Du30 and Marcos loyalists. Some are quick enough to judge. They probably don’t know the significance of it. Binay is no doubt an ally of the President because he is for the people. He is a human rights lawyer at that. The Detractors of the President and Bongbong Marcos who accuse them of human rights violations can never question Binay’s human rights role in the country. Even before the 1986 revolt. Binay’s alliance with the Du30-Marcos tandem can prove that they are not guilty of such accusations.

The President Supports Constructive Dissent

Roque stresses that President Du30 allows constructive dissent. Those who have grievances have space to protest. “The Church was very clear. It wasn’t political,” said Roque. However, this homily statement of Archbishop Socrates Villegas casts shadows over his non-political claim: “No politician lasts forever; only God does. Turn to the Lord and turn away from destructive politics. Peace to you all! We respect you. We call you Honorable. Be worthy of it,” he said.




Du30’s ICC Case

The case against Duterte before the ICC was filed amid the spate of killings linked to the government’s war on drugs.The complaint alleges that Duterte and at least 11 senior government officials are liable for murder and calls for an investigation, arrest warrants, and a trial. Roque, the only Philippine lawyer allowed to practice law at the ICC, nonetheless expressed openness to take on yet another role and assist Duterte if ever the latter would need his help.







Marcos and Martial Law

Bongbong Marcos, on the other hand, inherits the black media propaganda effects against his father. The late President Ferdinand Marcos is widely known as a dictator. He is allegedly guilty of martial law human rights violations. But he has no single case in that aspect. Most of all, the ill-gotten wealth false publicity. That ends up to be the wealth of humanity. The President already directs the Senate and Congress to look into that.

Binay’s Influence on the BiHoMaDu Alliance

The political assassination stints on the Binays still continue despite the Binay’s patriarch’s retirement from politics. He is now the Dean of the University of Makati. However, it is not a secret that his kingmaker, Pastor Boy Saycon is one of the advisers of President Du30. When some DDS supporters are not for Marcos as VP, they are supplemented by the many Binay-Honasan supporters who are solid Bongbong Marcos for VP crusaders. The BiHoMaDu alliance that stands for Binay, Honasan, Marcos, and Du30 gears Bongbong Marcos to be president someday.

How Sure Trillanes is with ICC when Du30’s Impeachment Even did not Pass Congress?

Senator Antonio Trillanes IV cannot hold his disappointment when congress rejected the president’s impeachment as fast as Senator Alan Peter Cayetano is confirmed by the commission on appointments as the new DFA Secretary. He swears to find other venues that cannot control the result in favor of Du30.

Big Dismay for Trillanes

Senator Antonio Trillanes IV was in great dismay when the impeachment complaint against the President was rejected by the House justice committee of congress. He warned that other groups will resort to other channels to seek justice and accountability of the country’s leader. He can only imply on the ICC.




Congress to ICC

The senator, however, gave limited details about the “other modes” that he talks about. The use of the International Criminal Court (ICC) has always been the next option. Nevertheless, if the case has no substance locally, how can it survive an international court? It is also bad timing for the president’s foes to hurdle him in any humanitarian bodies because they seem to have realized the actual situation of the drug war.










Blaming Fariñas

Trillanes also criticized House Majority leader Rodolfo Fariñas II for “not knowing” the difference between a witness and a complainant. He thought that the latter is a good lawyer but the fact that he cannot distinguish both convinced him that everything is maneuvered.

Willing to be Punished

Trillanes made his readiness known that he is willing to face future charges that the administration would throw upon him. He is however in denial of his guilt and still tries to push his luck. However, the tides seem to be not swaying on his side but rather against him. It’s only a matter of time that he can be castigated upon for all the troubles he had caused the government due to personal interests or false vindication.

A Bloody People Power is at Stake on PDu30’s Impeachment – Can ICC Take the Risk?

The Magdalo impeachment complaint against the president is just a mere propaganda for many analysts. It cannot destabilize the government as much as throwing accusations of state-sponsored killings of drug suspects to the UN. The destabilization label only emerges when Vice President Leni Robredo’s UN video release coincides with the impeachment filed. However, it is obvious that pro-administration supporters do not take this sitting down. They are willing to fight in the street until death if any international bodies like the ICC further interfere with the administration’s campaigns that would jeopardize PDu30’s reign.

Political Move

The Magdalo complaint is simply a legitimate political propaganda. It’s objective to remove the president from office is just too ambitious if not unreal. Various motives can be seen from the move. The chance to annoy, put the leader into a bad light, and perhaps try to persuade vulnerable pro-administration politicians to shift allegiance.




EJK Accusations

The allegation of current drug killings is something that mus be investigated. However, the allegation of DDS killings when PDU30 was still the mayor of Davao city cannot impeach the president. Its inclusion is clearly a technical mistake. In spite of this defect, the House can’t just support the complaint.

House Majority

PDU30 controls the House for one thing. No one can file another impeachment complaint against him for a year. This is pursuant to the 2003 Supreme Court ruling by Justice Carpio-Morales in Francisco vs. the House of Representatives. Thus the filing of Magdalo’s complaint actually helps rather than hurt DU30. This also allows DU30 to consolidate his own political base. The opposition should also do that after the impeachment complaint is trashed out




Bloody People Power

There are also calls to bring DU30 to the International Criminal Court at The Hague or ICC on the killings locally and overseas. This persists because of the influence of some powerful Liberal Party supporters. They can use a reputed DU30 ally who is a mayor, that flooded his town’s streets with banners denouncing the killings after around 60 of his constituents are murdered because of the drug war. It is rumored that other local government units are inclined to follow suit. Abroad, the UN special rapporteur on extra-judicial killings pronounces the Philippines as one of the worst places for human rights violations. The Filipinos hear these things but the majority of them back the president with their life. Can ICC take the risk on more deaths to come?

President cannot hide from ICC

President Rodrigo Duterte cannot hide behind presidential immunity if the International Criminal Court (ICC) files a case against him for the alleged extrajudicial killings under his administration.





ICC’s Jurisdiction

“The ICC can always assume jurisdiction if they find enough sufficient basis to do so,” De Lima said at a forum on extrajudicial killings and human rights at Miriam College. I do believe that many of those (alleged extrajudicial killings) are still really police or agents of the police, so it’s systematic, it’s State-inspired, if not State-sponsored. If that is proven, presidential immunity does not apply; she added.



Submission to any Investigating Body is Welcome

The Philippines is a State party to the ICC and the court has jurisdiction over genocide, crimes against humanity and war crimes. Presidential Communications Secretary Martin Andanar said the President is willing to submit himself for an investigation before any body.




The Palace should Understand Seriousness of ICC Warning

We’ve seen those ICC involvement in other countries in war crimes, crime against humanity and many more. They are stronger than any national leader – presidents or prime ministers. Once evidences are gathered, the accused will not have the chance to question them. It’s either surrender through diplomatic means or stage an international war!
