Bongbong Marcos’ spokesperson, Atty. Vic Rodriguez reacts to Atty. Macalintal’s statement. He explains the reason why not a single election protest for president or vice president was successful. It’s because “no protest, in the era of the digital election, ever go through the preliminary conference.” Marcos is more determined now to see this through until the last ballot in the pilot provinces is manually put into account after the Prelim. This is to see if the real result reflects to eject the fake vice president,” stressed Rodriguez.

Macalintal’s Election Protest Theory
Rodriguez’s reaction comes after Robredo’s counsel, Romulo Macalintal, said that not a single election protest was successful locally. This was allegedly the case since the start of automated polls in 2010. There’s no reason why the recount for a national position would be different.They are both from the VCMs and the CCS; Macalintal added.
Marcos’ Protest Has Come So Far
“Marcos’ case is only the protest that has come this far. It is now in the conduct of manual recount and judicial revision,” Rodriguez said. Macalintal’s overconfidence has no basis. The current progress of the election protest against his client is the ultimate proof. Suspicions even arise after the recount month and estimate for the start date are mentioned by him.
No Such Thing as Fake VP?
Macalintal also reacts to Rodriguez’ comment; “There is no such thing as ‘fake VP’ but there is such a thing as a ‘fake protest.’ Like that of Marcos said the veteran lawyer. It can be fully exposed once the recount is done,” he added. This is basically what Marcos wants also. Win or lose, the truth shall prevail. Any result is acceptable to the Marcos Camp. However, Ferdinand Marcos’ namesake does not part with his millions if he’s not sure if he’s the real VP.
Recount Procedure at the Supreme Court
The Supreme Court that sits as the PET, begins in February 2018 the recount of votes. It covers the three pilot provinces of Camarines Sur, Iloilo and Negros Oriental. Marcos chooses them as the best provinces. He’s certain that he could prove the irregularities alleged in his protest there. Macalintal said that the first ones to count are the ballots from the clustered precincts in Camarines Sur. It’s the vice president’s home province. The ballot retrievals are set on January 22, 2018. The recount should start by the second week of February. This two other pilot provinces can then follow.
In a face-off interview with Bongbong Marcos’ lawyer Atty. George Garcia, Robredo’s counsel Atty. Romulo Macalintal retaliates that there’s no cheating ever found involving Smartmatic’s machines. Macalintal recalls that some IT experts claimed that there were anomalies in the server’s behavior when the sudden lead of Robredo over Marcos happened. Marcos explains this himself in an earlier interview. Therefore, the veteran election lawyer challenges those professionals to prove the fraud even with just one vote.

Belittling IT Experts
Macalintal mocks the IT experts who give their expert opinions on the transmission trend and server behavior when the immediate twist of fate started on the night of the May 16, 2016, VP race. This is in contrast with Clean Elections advocate, Atty. Glenn Chong’s statement that says that the fraudulent activities during the latest national elections were not only manual but digital in nature. Aside from being a lawyer, he also has some IT background.
No Cheating by Smartmatic?
VP Robredo’s lawyer insists that Smartmatic did not cheat and there was no cheating during the 2016 elections as far as the PCOS machines are concerned. He admits that there may be some manual cheatings like the traditional vote-buying, harassing voters and all – but never involving the election machines.
Loyalists Witnessed Digital Manipulation
Many Bongbong Marcos supporters went to bed nicely late night after monitoring the VP election results on May 16, 2016. He was over one million votes ahead of Leni Robredo. Only to be shocked with nightmare upon learning from the early morning news that Robredo has the slim advantage. Such sudden twist of fate could not have happened if there’s no digital manipulation according to IT experts.
Recount is a Must Regardless of Who Wins
Marcos’ lawyer, Atty. George Garcia explains that they are open to the possibility that there’s no revision of the vote counts after the recount. The important thing is to measure the performance of Smartmatic earlier before the 2019 elections. If they are wrong, they wholeheartedly accept defeat. But for now, the immediate recount is a must.

Cannot Wait for the Recount
Rodriguez cannot hide his excitement upon receiving the resolution from the PET. He commented; “We cannot wait for the actual process to start because it is the only way we’ll be able to ferret the truth. We have always maintained that the ballots themselves are the best evidence in any election protest. This is the reason why we have always pushed for the early revision of ballots.
Suffering from Delays
Rodriguez added; We have suffered many delays because the other party keeps opposing our moves to open the ballots. 1 year and 3 months have already gone by. We hope that this will expedite the process so this issue can be settled once and for all. The Filipino people deserve to know their real Vice President is.”
Vacancies at PET
PET ordered the Office of the Acting Chief Administrative Officer to post the vacancies for the members of the Revision Committees. They now accept applications for the staffing complement. The Acting Clerk of the Tribunal will also screen the applicants for the position of Coordinators of the Revision Committee.
Exploratory Mission of the Supreme Court
The Tribunal created an Exploratory Mission that will locate and examine all ballot boxes in the contested provinces and cities. This is to facilitate their retrieval and transport to the Supreme Court compound for the said revision. As members of the team, the Tribunal designates the following SC employees: Attys. Mercedes Mostajo and Linuel Alindogan of the Office of the Chief Attorney as leaders; Joy Jemima Reyes and Jeffrey Raymond Atienza of the Cash Collection and Disbursement Division as Special Disbursing Officers; and Joery Gayanan. They will each receive a compensation of P5,000 monthly.
Vice President Len Robredo’s camp vowed that Bongbong Marcos’ election protest will last for six years. Sure enough, they are doing all they can to delay the process. Small details are questioned in Marcos’ courses of action after the preliminary conference. They claimed in their recent manifestation that Marcos is inconsistent with what was agreed. One significant detail is the reduction of the digital election witnesses in the first part. Instead of the 25 witnesses discussed in the prelim, Marcos insisted on the original 51 because their testimonies are substantial.

25 vs 10 Witnesses
Robredo’s Camp settled with 10 witnesses against the 25 of the shortened list of Marcos just in the first course of action. Since the Protestant questions the integrity of the entire automated election in 2016, they have to prove every aspect of the alleged fraudulent actions committed. This can start from the COMELEC’s connivance with Smartmatic down to the digital process of each transmission from the servers involved.
Nods on Transcript
In the Preliminary Conference transcript, the 25-10 witnesses agreement get the nods of both camps. However, after the 3 to 5 days compliance document, Marcos retained his 51 witnesses according to his lawyers because each of their testimony is relevant and material to prove the Protestant’s allegation that the automated election was not reliable.
Marcos’ lawyers beat the deadline on their compliance with the order of the Supreme Court to finally submit their priority details within 5 days after the Preliminary Conference. However, they refused to drop some of the witnesses to simplify the process. In order for the truth to come out, they need the testimonies of the 51 witnesses as originally submitted.
Not Acceptable for Robredo’s Camp
Naturally, since it is beneficial for Robredo to delay the process, it is expected that Macalintal’s team would vouch for the smallest details. As the rule of the thumb, only the Supreme Court can rule on the matter. The recount did not happen mid-August this year as per the estimate of Marcos’ lawyers. Therefore the former Senator might as well decide for the 2019 Senatorial elections.
VP Leni Robredo’s lawyer Romulo Macalintal seems to have lost his appeal as a veteran election lawyer. This is after his bullying against Bongbong Marcos. He calls Marcos boastful after he changes his pilot cities and shortlists his witnesses. The changes follow the Supreme Court guidelines. Robredo’s counsel also said that Comelec Chair’s referral fee from Smartmatic is not an evidence to dispute the integrity of the 2016 elections.

Comelec Chair as Victim
Comelec Chair Andres Bautista can dispute the claims of his wife all he wants but he is definitely not the victim here. The fact that he does not provide for his family financially anymore is already a big social offense. Denying his estrange wife what is legally due to her because of his inaccurate records is another family injustice.
Macalintal backs Chairman Bautista that the referral fee he receives from Smartmatic is not for cheating during elections. Therefore, it cannot be taken as such. He forgets that government officials are not allowed to accept any donations or gifts from anybody in relation to their job. The veteran election lawyer once again shows that he is biased in favor of his client, Robredo. But his bullying against Marcos is not working anymore.
Bautista’s family may be rich as he said. It is seconded by his brother but according to the records, they do not keep proper bookkeeping as required by the BIR. This is when it comes to their wealth. He can immediately declare the amount due to his wife if there’s proper accounting. By saying that they will divulge everything in due time does not help. Justice delayed is justice denied. They are obviously buying time.
Dragging Marcos into the Scandal
Bongbong Marcos can only say this amidst speculations that he is behind the fighting spirit of Mrs. Patricia Bautista; “I’m watching what you are reporting. That’s all I know. The Palace can confirm also confirm that his wife arranged the meeting between Mrs. Bautista and the President.” Nevertheless, most people are not interested if he’s involved or not. Chairman Bautista must be investigated fair and square.
