Bongbong Marcos’ spokesperson, Atty. Vic Rodriguez reacts to Atty. Macalintal’s statement. He explains the reason why not a single election protest for president or vice president was successful. It’s because “no protest, in the era of the digital election, ever go through the preliminary conference.” Marcos is more determined now to see this through until the last ballot in the pilot provinces is manually put into account after the Prelim. This is to see if the real result reflects to eject the fake vice president,” stressed Rodriguez.

Macalintal’s Election Protest Theory
Rodriguez’s reaction comes after Robredo’s counsel, Romulo Macalintal, said that not a single election protest was successful locally. This was allegedly the case since the start of automated polls in 2010. There’s no reason why the recount for a national position would be different.They are both from the VCMs and the CCS; Macalintal added.
Marcos’ Protest Has Come So Far
“Marcos’ case is only the protest that has come this far. It is now in the conduct of manual recount and judicial revision,” Rodriguez said. Macalintal’s overconfidence has no basis. The current progress of the election protest against his client is the ultimate proof. Suspicions even arise after the recount month and estimate for the start date are mentioned by him.
No Such Thing as Fake VP?
Macalintal also reacts to Rodriguez’ comment; “There is no such thing as ‘fake VP’ but there is such a thing as a ‘fake protest.’ Like that of Marcos said the veteran lawyer. It can be fully exposed once the recount is done,” he added. This is basically what Marcos wants also. Win or lose, the truth shall prevail. Any result is acceptable to the Marcos Camp. However, Ferdinand Marcos’ namesake does not part with his millions if he’s not sure if he’s the real VP.
Recount Procedure at the Supreme Court
The Supreme Court that sits as the PET, begins in February 2018 the recount of votes. It covers the three pilot provinces of Camarines Sur, Iloilo and Negros Oriental. Marcos chooses them as the best provinces. He’s certain that he could prove the irregularities alleged in his protest there. Macalintal said that the first ones to count are the ballots from the clustered precincts in Camarines Sur. It’s the vice president’s home province. The ballot retrievals are set on January 22, 2018. The recount should start by the second week of February. This two other pilot provinces can then follow.

Du30’s First and Second Supreme Court Appointees
Supreme Court Associate Justices Samuel Martires and Noel Tijam re the first and second appointees of President Du30 to the high court. They both came from the San Beda College of Law where the Chief Executive also graduated. This event coincides with RJ Nieto’s initial theory.
New Comelec Chair
Comelec Commissioner Sheriff Abas breaks many firsts in the poll body. He has yet to pass the Commission on Appointments to become the new Comelec chair. If so, he can be the first Comelec chair from Mindanao where the President is from. He has studied at the Ateneo de Davao University. Abas, 38, then becomes the youngest head of the poll body. Absolutely the first Comelec commissioner to become Comelec chair. By the look of it, he can be more loyal to the President than to the former President Pnoy who first appointed him as commissioner.
Abas’ Appointment Coincides with SC Changes
Abas’ nomination comes as Duterte pushes for a federal form of government. The movement requires a plebiscite run by the Comelec. Besides, the lower house is already at the back of the President with the supermajority. The remaining SC retirement replacements around the 2nd and 3rd quarter of 2018 should give the ruling party the majority votes during en banc sessions.
As a legitimate blogger, Nieto has the right to convey his analysis of the scenarios that might happen given the facts that he has access to as an avid supporter of the President. Both the administration and its detractor must play the game both in politics and through the media. It is noted that Robredo receives more favorable rulings from the Supreme Court than Bongbong Marcos nowadays. That can change drastically after the first quarter of 2018. When that happens, Nieto can be right that there is an intention for Marcos to be VP next year that can make the President safe from bad intentions.
The Supreme Court grants VP Leni Robredo’s request to provide her soft copies of the ballots and reports from the decrypted secure digital (SD) cards with no reason. These are from the provinces of Camarines Sur, Iloilo and Negros Oriental. They are the three pilot provinces designated by Marcos for his election protest priority provinces. Robredo earlier opposed this. In fact, she succeeds in blocking the ARMM Technical Test. Marcos thinks as per the previous interview that she should not have that privilege because she has no share in its costs.

Marcos Shouldered the Payment
The ongoing decryption activity was initiated solely by Marcos. He had to shoulder the decryption fee of Php 2.9M including an additional Php 2M for the initial supplies required by the COMELEC. Robredo did not join him in this undertaking. In fact, she aggressively opposed it from the start.
Robredo Camp is Happy with the Decision
Robredo’s Camp welcomes the PET’s decision because. It provides them with the additional security that the votes of the VP are the same as they are on the SD cards,” Robredo’s legal counsel Romulo Macalintal said. They can now coordinate with the Comelec to deal with procedure and supplies necessary for the soft copies, he added.

Unfair or No Big Deal?
The former senator paid for the cost of decryption and printing of ballot images from the pilot provinces amounting to P2,974,075 to be exact on top of is other expenses. Robredo seems to develop a habit to let Marcos pay for any major proceeding in the electoral protest. She has not even paid for her second installment of 7 million Pesos for her counter-protest. Comelec must look into its dismissal to be fair at least.
House Speaker Pantaleon Alvarez said that they could go straight to the impeachment court on SC CJ Maria Lourdes Sereno’s case. But he doesn’t want to do it to avoid repeating the unfair trial of the late Supreme Court Chief Justice Renato Corona. Alvarez wants to hear the case at the Congress first to see if there is evidence or not. This makes sense at the rate it is going. Previously, only the late Senators Joker Arroyo and Miriam Defensor-Santiago, and now VP Protestant Bongbong Marcos acquit Corona. They all agreed that his failure to disclose assets in his SALNs was not an impeachable offense. Marcos explained how he carefully balanced the pros and cons when he decided for Corona’s acquittal. The impeachment complaint against Chief Justice Maria Lourdes Sereno comes 5 years after her predecessor, the late Renato Corona, was removed from office. Both Sereno and Corona have been publicly called out by presidents.Then-president Benigno Aquino III consistently lashed out against Corona, calling his removal as key to achieving transparency and reforms in the judiciary.
Lack of Evidence Heard in the Congress
Lawyer Larry Gadon was grilled by not having evidence for Sereno’s manipulative acts at the SC and extravagance on spending. Those were no big deals. The “strongest” argument for impeachment facing Sereno is the allegation of untruthful declaration in her Statement of Assets, Liabilities, and Net Worth (SALN). She has, however, consistently denied these accusations. However, Corona got convicted despite the unclear proofs.
President Rodrigo Du30 asks Sereno many times to resign. The impeachment complaint filed against her is allegedly supported by him. He previously said he will not meddle with the process. Du30challenged both Sereno and Ombudsman Conchita Carpio-Morales to resign together with him due to the corruption allegations they all face.

No Presidential Influence to Bring Down Supreme Court CJ
Gadon also clears the President out. “I have met President Du30 in person about 5 times and we never talked. Just a shake hand. He has nothing to do with this.” Gadon again clarifies that the former President and now Congresswoman Gloria Macapagal Arroyo is not behind the complaint. Her previous appointee, Chief Justice Renato Corona, was impeached. Gadon is a member of Arroyo’s legal team. Some people perceive the current impeachment of the CJ as a revenge.
No Respect for the Congress
Umali said that lawyers Joshua Santiago and Aldwin Salumbides should respect the proceedings of the panel. Santiago and Salumbides in a forum explain that the panel should already vote instead of turning the impeachment proceedings into a “dog and pony show.” They also refer to Gadon’s action as “weak.” Both lawyers said they hope for fair impeachment trial at the Senate for the top magistrate.
The other lawyer of Sereno, Jojo Lacanilao, apologizes on behalf of his colleagues. He said that they did not intend to disrespect the panel. Lacanilao was sorry for offending the committee. They recognize the power of the committee and trusts that justice shall not evade the CJ should the case reaches the Senate. He explains that Santiago and Salumbides are just carried away by their emotions.
Afraid of Own Ghost
The Supreme Court CJ’s lawyers cannot contain their emotions at this early stage. Therefore their performance deteriorates as events become more intense. The same devastated the late Former CJ Renato Corona. It contributed to his demise. It’s natural to suspect as they do because what goes around comes around. Better yet, Marcos is hailed by the President as his likely successor. Therefore, the pressure is doubled on them at this time.
